STUDENT AGREEMENT COURSE TUITION A registration fee will be charged to the student. That fee includes all required instructional materials including the interactive course available 24/7 and the standard certificate processing service. We are so confident that you will enjoy our course that you may register and begin the course for FREE (excluding Arizona), with no obligation, to make sure that you like it. You will be asked to pay before you complete this course. You may do so by credit card over the Internet or by phone, or you can mail a money order or cashiers check. If you have not completed the course and you would like to cancel the course voluntarily within 30 days of payment, you will be granted a refund. You are not entitled to a refund at any time if you a) have been expelled for a security violation, b) or you have successfully completed the course. Arizona Only: When you decide to start the course, we will collect all fees before you begin the course. Money orders will need to be received before your registration can be activated. All fees will be sent to the appropriate state agencies on your behalf. This process will be done following the guidelines that the State of Arizona requires. COURSE SCHEDULE The course will be available to the student 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site or connectivity failure over which the course owner has no control. Anytime the student leaves the course whether the student clicked "log out", closed the window, or the computer froze the course progress will be saved. Virginia Only: You will have one attempt on the final exam each day. However, we provide you with a practice exam that you may take as much as you like before going to a testing center. PRIVACY POLICY The course provider will not sell, distribute and/or reveal any of your personal information, in part or whole, to anyone, for any reason, except to persons authorized by a court or by the state the student registered with to gain access to that information for official purposes. Therefore, we do not provide or sell any personal data to third parties unrelated to the reason you are taking this course. In some cases, we may collect information about you that is not personally identifiable. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using, and the URL of the website from which you linked or clicked to our website. This type of information is used solely for our own in-house statistics and/or to make appropriate system upgrades. Texas Students Only: You agree to allow the course provider to access third-party driver's license and auto registration databases for information regarding your driver's license and automobile registration for the sole purpose of validating your identity to meet Texas Education Agency (TEA) requirements for taking this course. ELIGIBILITY Arizona Only: Once you agree to the terms of the course and send us a copy of your citation, we will verify that you have given us correct personal data and we will run your drivers license through an Arizona state database to verify your eligibility to take a defensive driving course for the citation that you were given. Commercial licensed drivers are not eligible to take defensive driving courses unless court ordered according to Arizona Statute 28-3392C. Virginia Only: If you have a commercial driver's license you may not take this course and will need to take a Commercial Driver Improvement Clinic if you are trying to clear a citation. However, you may be eligible to take this course to add 5 safe driving points to your record if you have not taken a course in the past 2 years. If you are under the age of 20, you may not take this course if the DMV is requiring you to take the course. Please refer to the Virginia DMV's website for a classroom listing: www.dmv.state.va.us/webdoc/citizen/drivers/clinics.asp. This course may be taken once every 2 years for only one reason, unless you are specifically ordered by a court to take the course more than once within the 2 year time period. SYSTEM REQUIREMENTS To complete this course you will need a computer with the following minimum requirements: Internet access with at least a 56K modem, a reasonably recent browser (e.g. Internet Explorer 6.0 or greater, Firefox 1.5 or greater, Netscape 6.0 or greater, Safari 3.0 or greater, Opera 9.0 or greater, etc) and Adobe Flash Player. You must have both JavaScript and cookies enabled in your browser. The course requires the use of a pointing device such as a mouse. The course recommends that the hardware be equipped with speakers, although it is not necessary. Keep in mind that if you are behind certain firewalls it may affect your course navigation. If this just sounds like technical mumbo jumbo to you, don't worry. We make it incredibly easy for you to change browser settings or install all necessary plugins for free (even if you don't know what browser settings and plugins are). Just hit the "Support" button on your navigation bar once you're in the course. Most people already have the requirements, but if you don't, installing them will improve your overall web experience in general. If you're not sure what you've got, we'll help you figure it out. This course looks best and requires less scrolling at 800 x 600 resolution or higher. Arizona Only: You will need access to a printer, fax, or scanner to send us the required paperwork to get registered. COMPLETION AND CERTIFICATION POLICY The student agrees to complete all units of the approved curriculum in the allotted amount of time in order to receive a certificate of completion. The student may log in and out of the course as many times as they'd like whenever they would like. The school is prohibited from issuing a certificate of completion if the student has not met all the requirements for course completion and a student shall not accept a certificate under such circumstances. GRADING AND PROGRESS POLICY The student agrees that they may not be certified or given credit for the course unless they score the minimum required passing score or higher on the course. The course provider is prohibited from issuing a certificate of course completion if you have not met all of the other requirements for course completion. Once enrolled, you will be able to track your progress through the course at any time by clicking on "Course" on the navigation bar you'll find inside the course. RULES OF OPERATION AND CONDUCT The student agrees that he/she, and not any other person, will study the material in its entirety and complete the chapter quizzes and the final exam. It is illegal to attempt to circumvent this online course or provide false information. You may be expelled for attempting to circumvent any security measures, for allowing someone else to do any part of this course for you, or for rude, vulgar or disruptive behavior on the phone or via email toward any of the course provider's employees. If the course provider discovers that the student has willfully misrepresented himself, has cheated, or violated the rules of conduct, the student will be stopped from taking the course with no refund of the registration fees. In addition, the student may be prosecuted for perjury and other criminal acts which are punishable by law. SPECIAL NEEDS Because the program is self-paced, many students with reading, hearing, or learning handicaps may find that by simply taking a little extra time, they can pass the course. Students with hearing impairments will be supplied video transcripts. No other auditory information is required to complete the course. If these measures do not meet your needs, you will be referred to a classroom program that can offer the proper facilities. CANCELLATION AND REFUND POLICIES A full refund will be made to any student (excluding Arizona students, please read below for Arizona refund policies) who cancels the enrollment contract within 30 days of registering for the course and prior to completing the course. You are not entitled to a refund at any time if you a) have been expelled for a security violation, b) or you have successfully completed the course. If you have successfully completed the course and the jurisdiction will not accept the completion (with the exception of Arizona), the original certificate of completion must be returned within 30 days from the completion of the course. State or agency fees and a $5.00 processing fee will be withheld. The remaining balance will be refunded. Arizona Only: Once you have agreed to the terms of the course and have submitted payment, the State of Arizona requires that there be no refunds for any court or state fees unless: a) an officer fails to file a citation with a court and the cited person attends a diversion course for that citation; b) when a citation is dismissed by a jurisdictional court on its own motion, for technical problems that are not correctable under civil traffic rules (rules of the court); c) the court requests the refund to be granted. Refunds for the defensive driving course fee may be given at our discretion or if there are system problems that are not related to the student's computer and or internet service. If a course fee refund is granted, it will be sent by the same method as the original payment unless the student paid by credit card. If the student paid with a credit card then the refund will only be refunded to the credit card if it is within 30 days of the payment. Otherwise the refund will be paid by check. By agreeing to these terms, any credit card charges pertaining to the above fees cannot be refused by the cardholder through the lending credit card company if services have been rendered and the above refund terms do not apply. Any reference to a Money Back Guarantee on our website(s) does not apply to the Arizona program. CREDIT CARD DISPUTES In the event that a card holder or other authorized user disputes any portion or the entire amount charged on their credit card, such dispute shall first be directed to the company to provide a reasonable opportunity to resolve any credit card/debit card disputes. Disputes shall be submitted by completing and returning the Credit Card Dispute Form 101 within 45 days of the charge. The form can be found at: http://www.distancelearningcompany.com/simages/pdf/ccdisputesform.pdf. All disputes shall include the following: name of cardholder, address of card holder, name of student (if different than card holder), student ID# (registration #), phone number, address, email address, type of card (debit/credit), financial institution (bank), date of charge, amount of charge, disputed amount, brief description of the dispute, and requested action to be taken by the company. The company will contact the card holder within 30 days to resolve the dispute. If there is no response from the company within 45 days then the card holder can proceed with the dispute. All disputes must be submitted by completing and returning the Credit Card Dispute Form 101 via the following delivery method: fax, electronic mail, certified U.S. mail, or confirmed express delivery with signature. No telephone calls or standard mail will be accepted. Notice: Student/Cardholder agrees to the above terms and conditions. Further, student/cardholder hereby agrees to pay a $75.00 dispute processing fee if the student fails to adhere to the aforementioned dispute process, regardless if the dispute is valid or not. The student hereby authorizes the course provider to charge the credit card used as part of this purchase a fee of $75.00 immediately upon notification that the card holder has filed a dispute with their financial company without first following this dispute policy. Additionally, the student authorizes the course provider to charge the credit card used as part of this purchase any additional fees and costs associated with processing the dispute and $75.00 for each and every dispute arising from the matter and collection fees. A student must not use a credit card which does not belong to the student without permission from the cardholder. If a card is used without the cardholder's permission and the cardholder disputes the charge the student will not only be charged the full amount but any certificate obtained will become void and the appropriate authorities and jurisdictions will be notified. COURSE MISCELLANEOUS If you choose to print this page, you will have been furnished a copy of the school tuition schedule; cancellation and refund policy; and school regulations pertaining to absence, grading policy, progress, and rules of operation and conduct. If you choose not to print it, you can always find it in our FAQs, which can be accessed from the navigation bar. REPRESENTATIONS AND WARRANTIES The student represents and warrants that the user information and registration information provided by the student is true and correct, and acknowledges that the truth and accuracy of such information is a material inducement to the course provider in permitting the student to enroll in the course. The student further acknowledges and agrees that any willful or intentional misrepresentation by the student regarding such user information or registration information constitutes a breach of this agreement and of the representations and warranties by the student as provided in this agreement, and may subject the student to liability for damages incurred by the course provider as a result thereof, including but not limited to general, consequential, and punitive damages. This agreement constitutes the entire contract between the course provider and yourself, and verbal assurances or promises not contained herein shall not be binding. LIMITATION OF LIABILITY The student acknowledges and agrees that the liability of the course provider and their agents and employees for any act, omission to act, or negligence on the part of the course provider and their agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by the student.

By agreeing to these terms, any credit card charges pertaining to the above fees cannot be refused by the cardholder through the lending credit card company if services have been rendered and the above refund terms do not apply. Any reference to a Money Back Guarantee on our website(s) does not apply to the Arizona program. CREDIT CARD DISPUTES In the event that a card holder or other authorized user disputes any portion or the entire amount charged on their credit card, such dispute shall first be directed to the company to provide a reasonable opportunity to resolve any credit card/debit card disputes. Disputes shall be submitted by completing and returning the Credit Card Dispute Form 101 within 45 days of the charge. All disputes shall include the following: name of cardholder, address of card holder, name of student (if different than card holder), student ID# (registration #), phone number, address, email address, type of card (debit/credit), financial institution (bank), date of charge, amount of charge, disputed amount, brief description of the dispute, and requested action to be taken by the company. The company will contact the card holder within 30 days to resolve the dispute. If there is no response from the company within 45 days then the card holder can proceed with the dispute. All disputes must be submitted by completing and returning the Credit Card Dispute Form 101 via the following delivery method: fax, electronic mail, certified U.S. mail, or confirmed express delivery with signature. No telephone calls or standard mail will be accepted. Notice: Student/Cardholder agrees to the above terms and conditions. Further, student/cardholder hereby agrees to pay a $75.00 dispute processing fee if the student fails to adhere to the aforementioned dispute process, regardless if the dispute is valid or not. The student hereby authorizes the course provider to charge the credit card used as part of this purchase a fee of $75.00 immediately upon notification that the card holder has filed a dispute with their financial company without first following this dispute policy. Additionally, the student authorizes the course provider to charge the credit card used as part of this purchase any additional fees and costs associated with processing the dispute and $75.00 for each and every dispute arising from the matter and collection fees. A student must not use a credit card which does not belong to the student without permission from the cardholder. If a card is used without the cardholder's permission and the cardholder disputes the charge the student will not only be charged the full amount but any certificate obtained will become void and the appropriate authorities and jurisdictions will be notified. COURSE MISCELLANEOUS If you choose to print this page, you will have been furnished a copy of the school tuition schedule; cancellation and refund policy; and school regulations pertaining to absence, grading policy, progress, and rules of operation and conduct. REPRESENTATIONS AND WARRANTIES The student represents and warrants that the user information and registration information provided by the student is true and correct, and acknowledges that the truth and accuracy of such information is a material inducement to the course provider in permitting the student to enroll in the course. The student further acknowledges and agrees that any willful or intentional misrepresentation by the student regarding such user information or registration information constitutes a breach of this agreement and of the representations and warranties by the student as provided in this agreement, and may subject the student to liability for damages incurred by the course provider as a result thereof, including but not limited to general, consequential, and punitive damages. This agreement constitutes the entire contract between the course provider and yourself, and verbal assurances or promises not contained herein shall not be binding. LIMITATION OF LIABILITY The student acknowledges and agrees that the liability of the course provider and their agents and employees for any act, omission to act, or negligence on the part of the course provider and their agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by the student.
